Declaration of Legal Status as a long-term resident

Basic information

The status of long-term residence in the European Community is a legal status which is granted exclusively to citizens of third countries who have applied for permanent residence within the Czech Republic.

Legal status as a long-term resident in the European Community within the Czech Republic is declared concurrently with the issue of permission for permanent residence

If legal status as a long-term resident was not granted to a foreign national along with the issue of permission for permanent residence, the applicant (foreign national) can apply for this status to be granted subsequently on fulfilment of the following conditions:

  • 5 years continuous temporary residence within the Czech Republic
  • Submission of all necessary documents
  • The applicant’s behaviour has not led to any breach of public order or any threat to the security of the Czech Republic or any other EU member state
  • Proof of sufficient financial means to support permanent residence

As of 01.01.2011 residence issues are now dealt with by the Ministry of the Interior or the Czech Republic instead of the Foreign Police.

Who is entitled to apply?

  • a foreign national from a so-called “third-country”
  • a member of family of an EU citizen

How to apply

An application for declaration of legal status as a permanent resident within the Czech Republic can be made at the relevant office of the Ministry of the Interior (Department of Asylum and Migration Policy) according to the applicant’s place of residence.

If the applicant is not within the Czech Republic at the time of fulfilling the conditions, the application can be made at a Czech Diplomatic Mission abroad.

All submitted documents (except passport) must be in Czech language or officially translated into Czech language.
