Title

Permission for temporary residence for a member of family of an EU citizen.

Basic information

A family member can also apply for a Temporary Residence Permit allowing the stay in the territory of the Czech Republic.

 A member of family of an EU citizen can be:

  • a husband/wife
  • a parent
    • in the case of an EU citizen under 21 years of age, supported by the parent and living with the parent in a shared household.
  • a child under 21 years of age, or such a child of the husband/wife of an EU citizen.
  • a dependent direct relative (older or younger generation), or such a relative of the husband/wife of an EU citizen.
  •  an unrelated person who can reliably prove that he/she:
  • lived in a shared household with the EU citizen in his/her home country or in a country where he/she had permanent or long-term residence.
  • is a financial dependent of the EU citizen.
  • is unable to take care of him/herself due to long-term illness or disability without the personal care of the EU citizen
  • has a permanent relationship with the EU citizen similar to a family relationship, and lives with the EU citizen in a shared household.

The same regulations apply to a foreign national who has a familial relationship with an EU citizen.

How to apply

An application for permission for temporary residence can be made at any office of the Ministry of the Interior (Department of Asylum and Migration Policy) within 3 months of arrival in CZ. Applicants are advised to apply to the office nearest to their stated residence in case a personal visit to the office is necessary.

A foreign national is obliged to attend the application hearing in person if requested to do so.

All non-Czech records and documents must be translated into Czech for submission.

Documents and forms

Member of family of an EU citizen:

  • A completed and signed application for permission for temporary residence for a member of family of an EU citizen
    • forms are available at the relevant offices of the Ministry of the Interior of the Czech Republic, or can be downloaded from the Ministry website
      • when printing out a form from the MI CZ website the original size and colour of the form must be maintained.
  • personal identification
  • passport, EU citizen’s ID
  • 2 x photos (35 x 45 mm)
  • document in proof of status as member of family, or dependent, of EU citizen
  • this need not be submitted if the applicant is in CZ for reasons of employment, business or other paid work.
  • health insurance certificate
  • proof of accommodation in CZ

e.g. accommodation contract, rental contract, subletting agreement or written consent of an authorised person to accommodate a foreign national, with a verified signature.

  • there are no set legal or other fees

Time limit:

  • applications are processed within 60 days of submission
