Juridical persons and physical persons authorized for enterprise must, as originators of waste that they produce in their entrepreneurial activity, dispose of that waste exclusively in compliance with the relevant legal regulations – law No. 185/2001 Coll., on wastes, as amended, and accompanying decree to the law on wastes.
Trade wastes cannot be put to collection containers (garbage containers) belonging to the flat object in which the originator conducts his entrepreneurial activity. For putting entrepreneurial waste it is not possible to use collection containers for sorted or large volume waste either that are located in the territory of the municipality and serve exclusively for the inhabitants of the City (physical persons). The use of the above-mentioned collection containers for putting waste of enterprise is possible only with the relevant consent (contract) and under the conditions provided for by the municipality (Municipal Authority of the Capital of Prague).
The originator of waste may fulfil his duties in several manners:
-
he will ensure removal of originating mixed and separated waste through a removal firm that he will select himself and they will conclude a contract.
-
the originator of waste will ensure removal of mixed waste himself and for the sorted components of waste – paper, plastic, glass, tetra packs he will participate in the system of the Capital of Prague and will use, on the basis of the contract with the Capital of Prague, colour containers for separated waste serving for the inhabitants of the City.
-
in case the originator of waste has leased non-residential premises in the house, the owner of the real estate may help the originator of waste by undertaking in the contract of lease to ensure removal firm (authorized person) for the originator of waste. Through the removal firm he will ensure collection containers for him for entrepreneurial municipal waste (mixed), or for sorted components (paper, plastic, glass, etc.). For the liquidation of such waste the owner of the real estate will re-invoice the amount required by the removal firm to the originator of waste. This way is applied, first of all, in letting of office premises where similar wastes originate as those from the inhabitants of the house.
The main duties of originators of waste according to § 16 of law No. 185/2001 Coll., on wastes, include:
-
To sort wastes according to the individual kinds and categories and collect them separately.
-
As priority to ensure use of waste before its removal.
-
To secure wastes against depreciation, misappropriation or leakage.
-
To hand over the produced wastes only to the ownership of a person authorized for takeover of waste according to the law on wastes.
-
To dispose of dangerous wastes exclusively with the consent of the state administration body (Municipal Authority of the Capital of Prague).
-
To keep continuous records of produced waste.
